1. General

Access to and use of this website and the products and services available through it (collectively, the “Services”) are subject to the following terms, conditions, and notices (the “Terms of Service”). By using the Services, you agree to all the Terms of Service, which may be updated by us from time to time.
Access to this website is provided on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if, for any reason, this website is unavailable at any time or for any period.
The Terms of Service apply to the sales contract between the customer of Donkervoort.com who has purchased one or more products through the webshop and Donkervoort Automobielen B.V.

2. Privacy Policy

Our privacy policy, which sets out how we will use your information, can be found in the Privacy Policy. By using this website, you consent to the processing described therein and warrant that all data provided by you is accurate.

3. Terms of Sale

By placing an order, you are offering to purchase a product subject to the following terms and conditions.
All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability, and any guarantees or representations regarding delivery times apply only within The Netherlands and are subject to delays resulting from postal issues or force majeure, for which we will not be held responsible.

To contract with Donkervoort, you must possess a valid credit or debit card issued by a bank acceptable to us. Donkervoort reserves the right to refuse any request made by you. If your order is accepted, we will inform you via email. By placing an order, you confirm that all details provided by you are true and accurate, that you are authorised to use the credit or debit card used for the order, and that there are sufficient funds to cover the cost of the goods.
The cost of foreign products and services may fluctuate, and all advertised prices are subject to change.

4. Our Contract

When you place an order, you will receive an acknowledgment email confirming receipt of your order. This email is an acknowledgment only and does not constitute acceptance of your order. A contract is formed only when we send you a confirmation email stating that the goods you ordered have been dispatched. Only the items listed in the confirmation email will form part of the contract.

5. Pricing and Availability

While we strive to ensure that all details, descriptions, and prices displayed on this website are accurate, errors may occur. If we discover an error in the price of any goods you have ordered, we will inform you as soon as possible and offer you the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and have already paid, you will receive a full refund.

Prices displayed on the website include deliveries both within and outside the European Union. All prices are inclusive of VAT. Any additional handling or shipment costs are determined by the type of shipment and the delivery address. These costs are shown separately before the order is placed and are also included in the order confirmation email.

6. Payment

Upon receiving your order, we perform a standard pre-authorisation check on your payment card to ensure sufficient funds for the transaction. Goods will not be dispatched until payment has been received or pre-authorisation is completed successfully.

All current browsers support SSL cryptography. Your payment data is not accessible to third parties.

7. Return Policy

Under EU legislation, you have 14 days from receipt of your order to reconsider your purchase. During this period, you may cancel and return your order without providing a reason. After receiving the returned goods, we will refund the full order amount within 14 days. Return shipping costs will not be reimbursed. You may also exchange items for a different size or colour, where applicable.

The purchase price will be reimbursed within 14 days of termination if the following conditions are met:

  • All returned items must be in their original condition, including packaging. For example, shoes must be returned with their original box.

The consumer is responsible for any additional return costs.

Returned goods remain your responsibility until they reach our office in Lelystad, NL. Please package returns securely to avoid damage during transit. We are not responsible for items returned in error.

Damaged or Defective Goods
If you receive damaged or defective goods, you may return them. Please indicate whether you would like a replacement or a refund. All returned items must be in their original condition, including packaging.

Incorrect Items Delivered
If you receive incorrect items, please contact Donkervoort Automobielen B.V. within 14 days of delivery. Return the incorrect items, and we will send out the correct items upon receipt.

Transportation Damage
If a package is visibly damaged on delivery, refuse the delivery. If you accept delivery and discover damage later, you will not be eligible for a refund.

8. Warranty

Legal Warranty
Under Directive 44/99/CE, Donkervoort provides a warranty for defects or non-conformity of products. This may include replacement, price reduction, or contract resolution. Warranty claims must include proof of purchase.

Warranty Claims
Claims must be submitted within 60 days of reporting the defect. During this time, the product may not be used.

9. Event Cancellation Policy (Factory Tours)

The following cancellation policy applies only to individual tickets and not to group bookings. For group bookings, please refer to the specific agreement terms.

  • 29–42 days: 50% of fare.
  • 28–14 days: 75% of fare.
  • 13–0 days: 100% of fare.

If you wish to move your booking to another date, please contact us as soon as possible. Date changes may be accommodated depending on availability and provided they are requested no later than 14 days before the event. Additional fees may apply.

For group bookings or further information, please check your agreement or contact us directly.

10. Prohibitions

You must not misuse this website by committing criminal acts, transmitting malicious software, hacking, corrupting data, or disrupting services. Breaches of these terms may be reported to law enforcement, and we will disclose your identity where necessary.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

11. Intellectual Property, Software, and Content

All intellectual property rights on this website remain the property of Donkervoort or its licensors. You may not reproduce, distribute, or use any content for commercial purposes without permission.

12. Registration

Donkervoort reserves the right to close accounts if users misuse proxy IPs or disrupt services.

13. Disclaimer of Liability

The material on this website is provided without guarantees. Donkervoort is not liable for any loss or damages arising from use of this website.

14. Linking to This Website

You may link to the homepage, provided it does not damage our reputation or imply unauthorised endorsement.

15. Complaints

We operate a complaints procedure to resolve disputes. Please contact us with any issues.

16. Applicable Law and Jurisdiction

These terms are governed by Dutch law. Disputes will be subject to the exclusive jurisdiction of the Dutch courts.
